Terms of use moolt

These Terms of Use (“Terms”) govern access to the moolt.site website, personal account, page editor, widgets, analytics, tariffs and other functions of the moolt service (“Service”).

By using the Service, creating an account, publishing a page or posting any content through moolt, you acknowledge that you have read, understand and accept these Terms. If you do not agree to the Terms, do not use the Service.

1. Basic terms

moolt, Service - an online service for creating public pages, link-in-bio pages, cards, widgets, links and other elements accessible through moolt.site and related interfaces.

User is an individual or representative of an organization using the Service.

Account - User’s account in the Service.

Page is a public or limitedly accessible page created by the User using the Service.

User Content - any materials that the User creates, uploads, publishes, inserts or otherwise posts through the Service, including texts, images, files, links, cards, widgets, titles, descriptions, avatars, covers, profile data and page settings.

Administration - persons who ensure the operation of the moolt Service.

2. Purpose of the Service

moolt allows Users to create and customize public pages, post links, visual cards, images, files, social links, widgets and other elements to represent themselves, their project, business, product, portfolio or community.

The Service may include free and paid features, analytics, design settings, publishing capabilities, page management, integrations and other tools, the availability of which may vary.

3. Registration and account

To access certain features of the Service, you may need to register an account.

The user undertakes:

  • provide reliable and current data when registering and using the Service;
  • do not impersonate another person, organization, brand or project representative without proper authority;
  • ensure the safety of account access data;
  • immediately notify the Administration of unauthorized access to your account or suspicious activity;
  • do not transfer your account to third parties if this violates these Terms or the rights of others.

All actions performed through the User's account are considered to be performed by the User, unless proven otherwise.

4. Age and legal capacity

By using the Service, the User confirms having the necessary legal capacity to accept these Terms.

If the User is using the Service on behalf of an organization, the User represents that they have the authority to accept these Terms on behalf of such organization.

If applicable law requires the consent of a parent, legal representative or other additional conditions for the use of online services, the User must obtain such consent before using the Service.

5. User Content

The User independently determines what Content to post on the Service and bears full responsibility for such Content.

User Content includes, in particular:

  • texts, headings, descriptions, signatures and public messages;
  • photographs, images, avatars, covers, graphics and other visual materials;
  • downloadable files;
  • links to websites, social networks, instant messengers, payment pages, forms, stores, videos, documents and other external resources;
  • cards, blocks, buttons, widgets, built-in elements and page settings;
  • page titles, user identifiers, metadata and other public elements.

The user guarantees that:

  • has all the rights, permissions and consents necessary to post the Content on the Service;
  • placement of the Content does not violate the rights of third parties, including copyright and related rights, trademark rights, rights to the image of a citizen, rights to personal data, trade secrets and other rights protected by law;
  • The content is legal, substantially reliable and does not mislead users;
  • links, files, widgets and external resources posted on the page are not used for fraud, phishing, malware distribution, spam or other abuse.

6. Rights to Content

The User retains the rights to the User's Content. Posting Content on the Service does not mean transferring exclusive rights to the Administration.

By posting Content on the Service, the User grants the Administration a non-exclusive, royalty-free, worldwide permission to use, store, copy, technically process, display, transmit and publish the Content to the extent necessary for:

  • operation of the Service;
  • displaying the User’s pages and widgets;
  • storage of backup copies;
  • ensuring security, moderation and support;
  • improving the technical operation of the Service;
  • compliance with these Terms and the requirements of the law.

This permission is valid for the period the Content is posted on the Service and a reasonable period after removal of the Content, if necessary for backup, security, dispute resolution, compliance with the law, or protection of the rights of the Administration and third parties.

The Administration is not obliged to pre-check all User Content and does not confirm the accuracy, legality or safety of materials and links posted by Users.

7. Prohibited content and actions

The User may not use the Service to post, distribute, promote or facilitate access to materials and activities that:

  • violate applicable law or the rights of third parties;
  • contain fraud, deception, phishing, scams, pyramid schemes, fake sweepstakes, false promises of income or misleading offers;
  • aimed at collecting logins, passwords, payment information, confirmation codes, personal data or other confidential information fraudulently;
  • contain spam, bulk unwanted messages, manipulative redirects, clickbait, automated cheating or abuse of external platforms;
  • distribute malware, exploits, malicious files, scripts, instructions for bypassing security systems, or links to such materials;
  • contain illegal adult content, sexual exploitation, images of minors of a sexual nature, coercion, blackmail, intimate materials without the consent of the persons depicted or links to such materials;
  • contain pornographic or other adult content if its placement, promotion or access to it violates the law, the rules of external platforms, the rights of third parties or the requirements of the Administration;
  • promote violence, terrorism, extremism, illegal trafficking in weapons, drugs, counterfeit documents, stolen data or other prohibited goods and services;
  • contain threats, bullying, stalking, hate speech, discrimination, doxxing or calls for harm;
  • violate intellectual property rights, including the illegal distribution of music, videos, images, programs, books, courses, databases or other materials;
  • illegally use brands, logos, names, photographs, business reputation or appearance of third party pages;
  • mislead regarding the User’s identity, authority, connection with a brand, organization, government body, charity project or public figure;
  • violate the rules of payment systems, social networks, marketplaces, hosting, advertising platforms or other external services;
  • create an excessive load on the Service infrastructure, interfere with the operation of the Service or bypass technical limitations;
  • use automated means of access, parsing, registration, publication or testing without the written permission of the Administration;
  • attempt to gain unauthorized access to accounts, data, systems or infrastructure of the Service;
  • use the Service in a way that may cause harm to the Administration, other Users, page visitors or third parties.

The Administration has the right to independently assess the compliance of the Content and actions of the User with these Terms, applicable laws, security requirements and the interests of the Service.

8. Links, widgets and external resources

moolt pages may contain links, buttons, cards, widgets and embedded elements leading to external sites, applications, instant messengers, payment pages, forms, stores, social networks and other resources.

The User is responsible for all external resources posted or promoted by the User through the Service, including their content, safety, legality, correctness, relevance and compliance with the rules of third platforms.

The administration does not control external resources and is not responsible for:

  • content of external sites and applications;
  • availability of external resources;
  • actions of owners of external resources;
  • goods, services, payments, subscriptions, deliveries, returns or communications carried out outside the Service;
  • collection and processing of data by external resources;
  • damage caused by clicking on external links or using external widgets.

The administration has the right to limit, hide or delete links, widgets, files or pages if they violate these Terms, create a risk for visitors, are used for abuse or cause justified complaints.

9. Publicity of pages and indexing

Pages published by the User may be accessible to any visitors on the Internet, unless the Service interface provides for other access settings.

The User understands and agrees that public Content may:

  • viewed, copied and distributed by third parties;
  • indexed by search engines;
  • saved in caches, archives, screenshots and third-party services;
  • remain accessible outside the Service even after deleting the page from moolt.

The User independently evaluates what data, images, files and links can be published on the User's page.

10. Personal data and images of people

The user is obliged to post personal data, photographs, images, contacts, links to profiles and other information about individuals only if there is a legal basis and the necessary consents.

The User has no right to publish through the Service:

  • personal data of third parties without legal basis;
  • documents, addresses, telephone numbers, payment information, medical information or other sensitive information without proper authorization;
  • photographs, videos or other images of people, if such posting violates their rights;
  • materials that reveal a person’s private life without that person's consent.

The processing of personal data by the Service itself is governed by a separate Privacy Policy, if such a policy is published by the Administration.

11. Analytics

The Service may provide the User with analytical functions, such as page views, link clicks, interaction statistics or other indicators.

Analytical data may be approximate, aggregated, technically limited, or dependent on browser settings, blockers, external services and infrastructure. The administration does not guarantee the absolute accuracy, completeness or continuous availability of analytics.

The User has no right to use the Service’s analytics to illegally track visitors, violate their privacy, de-anonymize, discriminate or otherwise abuse.

12. Paid features, tariffs and Pro features

The Service may offer paid features, Pro features, plans, subscriptions, or other commercial options. The specific composition, price, validity period and limitations of paid functions are displayed in the Service interface or in other materials published by the Administration.

If the User purchases a paid feature, the User undertakes to provide correct payment information and pay for the selected plan under the terms specified at the time of purchase.

moolt PRO connects for one public page. Payments can be made over a fixed period of 1, 3, 6, 12 or 24 months. If auto-renewal is enabled during payment, the next period is debited automatically until the User cancels auto-renewal or unlinks the saved payment method in their personal account.

Payments may be processed by external payment providers, including YuKassa. In this case, the rules, fees, restrictions and documents of the relevant provider may apply to the payment. The administration does not store the full bank card number, CVV code and one-time bank codes. For auto-renewal, the Administration may store the saved payment method identifier received from the payment provider and secure payment method display data, such as the last digits of the card.

The user can cancel auto-renewal or unlink the card in the page settings, subscription section, subscription management. When the card is unlinked, the saved payment method identifier is deleted from the moolt system, the card is no longer displayed in your personal account, and new recurring charges for this payment method are stopped. An already paid moolt PRO period is retained until the end date unless otherwise indicated in the interface or required by law.

Conditions for returns, cancellations of subscriptions, recalculations and disputed payments may be governed by a separate return policy or rules published by the Administration. If a separate return policy is not published, return issues are considered by the Administration taking into account applicable law, the actual use of paid functions and the circumstances of the application.

The administration has the right to change the composition, cost and conditions of paid functions. Changes do not apply retroactively to a period already paid for, unless otherwise required by law or more beneficial to the User.

13. Moderation, restrictions and deletion of pages

The Administration has the right, but is not obligated, to check the Content, pages, links, widgets, files, accounts and actions of Users.

The administration may, without prior notice:

  • hide, limit, deindex or delete the page;
  • remove or restrict individual Content, file, link, card, button or widget;
  • temporarily or permanently block your account;
  • limit publication, file downloading, use of links, widgets, analytics or paid functions;
  • refuse to create, change or save the page;
  • suspend access to the Service in whole or in part;
  • transfer information to the competent authorities if required by law or necessary to protect rights and safety.

Such measures may be applied if the Administration considers that:

  • The User has violated these Terms;
  • Content or actions of the User violate the law or the rights of third parties;
  • the page is used for fraud, phishing, spam, malicious activities or other abuse;
  • Content creates a risk for visitors, other Users, the Service or the Administration;
  • a complaint has been received from the copyright holder, visitor, external platform, payment provider, hosting, government agency or other person;
  • this is necessary for technical safety, prevention of damage or compliance with the law.

The Administration is not obliged to notify the User in advance about moderation measures if such notification may increase the risk, interfere with the investigation, violate the law or the rights of third parties.

The user can contact support to explain the reasons for the restriction, if such a communication channel is available. The administration has the right to refuse to restore the Content, page or account if the violation is confirmed or the risk remains.

14. Content complaints and rights violations

If you believe that a page or Content on moolt violates your rights, the law, or these Terms, you may submit a complaint to the Administration through available communication channels.

The complaint should, if possible, contain:

  • a link to a page or specific Content;
  • description of the violation;
  • information confirming your rights or legitimate interest;
  • contact details for feedback;
  • a statement about the accuracy of the information provided.

The administration has the right to request additional information, limit controversial Content during the inspection, refuse to consider an incomplete or unreliable complaint, or take measures at its own discretion.

When filing a complaint, the applicant is responsible for the accuracy of the information provided and the legality of the applicant's claims.

15. Intellectual property of the Service

All rights to the Service, including program code, interface, design, brand elements, databases, technical documentation, domain names, logos, interface texts and other moolt materials, belong to the Administration or its licensors, unless otherwise indicated.

The User receives a limited, revocable, non-transferable right to use the Service in accordance with these Terms.

The user has no right:

  • copy, modify, distribute, sell, rent or create derivative products based on the Service without the permission of the Administration;
  • remove copyright, trademark or other rights notices;
  • use the moolt name, logo or brand elements in a manner that creates the impression of partnership, endorsement or official affiliation without written permission;
  • reverse engineer, decompile, or attempt to derive source code unless prohibited by law.

16. Availability and changes to the Service

The Administration strives to maintain the operation of the Service, but does not guarantee that the Service will be available continuously, without errors, delays, data loss, technical failures or restrictions.

The Service may be changed, updated, temporarily suspended or discontinued in whole or in part. Individual features may be added, changed or removed.

The Administration is not responsible for the inability to use the Service if it is caused by:

  • technical failures, software or infrastructure errors;
  • the actions of hosting providers, payment providers, social networks, external APIs, DNS, registrars, CDNs or other third parties;
  • actions of the User or third parties;
  • blocking, restrictions, legal requirements or decisions of government bodies;
  • force majeure circumstances;
  • preventive, emergency or planned work.

17. Backups and data safety

The Administration may create backup copies of data to ensure the operation of the Service, but is not obligated to guarantee the restoration of any Content, page, file, setting or history of changes.

The User is responsible for independently maintaining copies of important materials posted by the User on the Service.

The administration has the right to delete Content, pages, files, accounts or data if necessary to comply with these Terms, legal requirements, security, maintenance or infrastructure management.

18. User's responsibility

The user is responsible for:

  • all Content posted through the User's account;
  • legality and safety of links, files, widgets and external resources;
  • respect for the rights of third parties;
  • obtaining consents and permissions to use images, personal data, brands, music, videos, texts, files and other materials;
  • the reliability of public statements, offers, prices, conditions, descriptions of goods, services, events, fees, donations and other materials on your page;
  • fulfillment of obligations to visitors, clients, subscribers, customers, partners and other third parties;
  • compliance with the rules of external platforms and services to which links or widgets of the User lead.

The User undertakes to reimburse the Administration for losses, expenses, claims, fines and demands of third parties arising in connection with the User's violation of these Terms, the law or the rights of third parties, to the extent permitted by applicable law.

19. Limitation of liability of the Administration

The Service is provided "as is" and "as available". The Administration does not guarantee that the Service will meet all the User’s expectations, will work without errors, or will ensure the achievement of commercial, marketing, financial or other results.

To the extent permitted by applicable law, the Administration is not responsible for:

  • User Content;
  • actions or inactions of Users and page visitors;
  • external sites, applications, widgets, payment pages, forms, social networks and other resources;
  • goods, services, payments, subscriptions, returns, deliveries, consultations, events or promises offered by Users through their pages;
  • loss of profits, customers, data, reputation, traffic, sales, advertising budgets or other indirect losses;
  • consequences of following links, downloading files or interacting with external resources;
  • blocking, deleting, limiting or unavailability of pages, if such measures are related to these Terms, security, law or technical reasons.

Nothing in these Terms limits liability that cannot be limited under applicable law.

20. Termination of use of the Service

The User may stop using the Service at any time. If the Service interface allows you to delete a page, Content or account, the User can use the corresponding functions.

The Administration has the right to terminate or limit the User’s access to the Service in the cases provided for in these Terms, as well as if further provision of access creates a legal, technical, reputational or other significant risk.

After termination of access, certain provisions of these Terms will continue to apply to the extent necessary by their meaning, including provisions regarding Content rights, liability, limitation of liability, moderation, complaints and dispute resolution.

21. Changes to the Terms

The administration has the right to change these Terms. The new edition of the Terms comes into force from the moment of publication on the website or in the Service interface, unless a different date is specified in the new edition.

Continued use of the Service after the changes come into force means the User agrees with the new version of the Terms.

If the User does not agree with the changes, the User must stop using the Service.

22. Related documents

Separate documents may apply to the use of the Service if they are published by the Administration, including:

  • Privacy Policy;
  • Return policy;
  • rules of individual tariffs, Pro-features, promotions or promotional codes;
  • instructions, restrictions and warnings posted in the Service interface.

If there is a conflict between these Terms and the special rules for a particular feature, the special rules will apply to the applicable feature to the extent of the conflict.

23. Feedback

The User may send questions, complaints, notifications of violations and requests to the Administration via available communication channels published on the website or in the Service interface.

The administration has the right to respond to requests within a reasonable time, request additional information and refuse to consider requests that are incomplete, false, repeated, abusive or not related to the Service.

24. Final provisions

If any provision of these Terms is found to be invalid or unenforceable, the validity of the remaining provisions will not be affected.

Failure by the Administration to exercise any right under these Terms does not mean a waiver of such right.

The User has no right to transfer the User's rights and obligations under these Terms without the consent of the Administration. The Administration has the right to transfer rights and obligations under these Terms in connection with the development, reorganization, sale, transfer or other legal operation related to the Service.

These Terms constitute an agreement between the User and the Administration regarding the use of the Service and replace previous agreements on this subject, unless otherwise specified in separate documents.
